Terms of Service

These terms govern your use of tomomind — the reminder service you chat with as "tomo" — in your browser at tomomind.com/app or on Telegram — an independently operated service based in West Bengal, India (registered as a micro-enterprise under India's Udyam scheme). By messaging tomo you agree to them. They're written to be read — if anything is unclear, ask us before relying on it.

1. What tomo is (and isn't)

• tomo stores reminders, todos and habits you create by texting it, and messages you at the times you set.
• tomo is a convenience, not a safety-critical system. Don't rely on it as your only safeguard for medication, medical care, legal deadlines, or anything where a missed message could cause serious harm. Delivery ultimately depends on your chosen channel (Telegram or push notifications), your device, and your network.
• tomo delivers over third-party channels (Telegram, your browser's push service). Your use of those platforms is governed by their own terms.

2. Your account

Your phone number is your account. You must control the number you use. If you lose the number, you lose the account — we can't verify ownership any other way. You're responsible for what's sent from your number.

3. Free tier

The free tier includes unlimited todos, a limited number of concurrently-armed reminder slots, a limited number of habits, and the morning digest. Free limits may be tuned over time; anything you've already created is never deleted because a limit changed.

4. Pro, billing & renewals

• Pro is sold as a monthly subscription or a one-time lifetime purchase. Prices are shown at checkout; launch pricing may change for new subscribers, never retroactively for existing ones.
• Payments are processed by Dodo Payments as merchant of record. Your receipt and card statement will reflect that. tomo never sees your payment credentials.
• Monthly subscriptions renew automatically until cancelled. Cancel anytime by texting subscription to tomo and using the manage link — access continues to the end of the paid period, then your account returns to the free tier.
• When a plan lapses, nothing is deleted: items beyond free limits are paused, and any later payment reactivates them.
• "Lifetime" means the lifetime of the tomo service, not yours or the universe's. If tomo ever shuts down permanently, recent lifetime purchases (last 12 months) will be refunded pro-rata where the payment provider makes that possible.

5. Refunds

• Monthly: you can cancel anytime; renewals already charged aren't generally refunded, but if you cancel within 48 hours of an unwanted renewal and haven't meaningfully used Pro since, ask — we're reasonable.
• Lifetime: full refund within 14 days of purchase, no questions asked.
• Refund requests go through the payment provider's receipt link or our contact address below.

6. Acceptable use

Don't use tomo to harass anyone, to schedule unlawful activity, to probe or overload the service, or to resell access. tomo may rate-limit or suspend numbers that abuse the service or degrade delivery for other users.

7. Messaging consent

By texting tomo first, you consent to receive the messages you set up (reminders, habit pings, the digest). Text stop at any time and all outbound messaging ceases immediately. Ambient messages like the digest automatically quiet down if you stop replying.

8. Service changes & availability

tomo aims to deliver reminders within a minute of their scheduled time, but is provided "as is" without warranties — outages of chat platforms, hosting, or upstream providers can delay or drop messages. Features may evolve; anything that materially reduces what you paid for entitles you to a pro-rata refund of the current period.

9. Liability

To the maximum extent allowed by law, tomo's total liability for any claim is limited to the amount you paid in the 12 months before the claim (zero for free-tier users). tomo is not liable for indirect or consequential damages — including anything that happens because a reminder didn't arrive (see §1).

10. Termination

You can leave anytime: text stop, or ask for full data deletion. We may terminate accounts that violate §6, with notice in the chat where practical.

11. Governing law

These terms are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.

Family plan & Circles

The Pro plan includes Circles: reminders you set for up to 3 linked people. A person only ever receives messages after they themselves reply "yes" to an invite, and they can stop at any time by replying leave circle or stop. Message allowances per linked person follow the standard Family allowance and adjust with carrier pricing. "Lifetime" means the lifetime of the tomomind service. Founding-price lifetime is limited to the first 50 purchasers.
